Supreme Court on Monday said that Aadhaar cards, being issued under a key scheme of the UPA-2, are purely voluntary and that Centre and state government departments cannot demand the card as the sole proof of identity in order to provide a service.

The top court's interim directions came in response to a PIL filed by a former judge questioning the legal sanctity of the Aadhaar card.

In his plea, K.S. Puttaswamy, a retired judge of the Karnataka high court, challenged the decisions of some states to make Aadhaar cards compulsory for a range of basic activities, including salary and PF disbursals, marriage and property registrations, as well as issuing new gas connections. It alleged that through the Aadhaar scheme, even non-citizens are likely to be given benefits, such as cash transfers.

The court directed the Centre to ensure that Aadhaar cards are not issued to illegal immigrants.

पगार आणि प्रॉव्हिडन्ट फंडाच्या पैशांचे वाटप किंवा मालमत्ता व्यवहार आणि विवाह इत्यादींच्या नोंदणीसाठी 'आधार कार्ड'ची सक्ती करण्याच्या अनेक राज्य सरकारांच्या निर्णयाविरुद्ध कर्नाटक उच्च न्यायालयाचे नवृत्त न्यायाधीश न्या. के.एस. पुट्टास्वामी यांनी जनहित याचिका केली होती. या याचिकेवरील सुनावणीत न्या. बी.एस. चौहान व न्या. शरद बोबडे यांच्या खंडपीठास केंद्र सरकारने ही माहिती दिली.

आम्ही कोणालाही आधार कार्डची सक्ती केलेली नाही, असे केंद्र सरकार व प्राधिकरणाच्या वकिलांनी सांगितले. मात्र, याचिकाकर्त्यांतर्फे ज्येष्ठ वकील डॉ. अनिल दिवाण यांनी असे निदर्शनास आणले की, 'आधार' सक्तीचे नाही, असे येथे सांगितले जात असले तरी महाराष्ट्र शासनाने काढलेल्या आदेशावरून मुंबई उच्च न्यायालयाच्या निबंधकांनी कर्मचार्‍यांनाच नव्हेतर न्यायाधीशांनाही पगार घेण्यासाठी आधार कार्ड सक्तीचे केले आहे. महाराष्ट्र सरकारने अलीकडेच विवाह नोंदणीसाठीही आधार कार्डची सक्ती करणारा आदेश काढला आहे, असेही त्यांनी सांगितले. घुसखोरांना 'आधार' देऊ नका शेजारच्या देशांतून भारतात घुसखोरी करून येथे बेकायदा राहणार्‍या लोकांना सरकारने 'आधार कार्ड' देऊ नयेत; अन्यथा त्यांच्या बेकायदा वास्तव्यास कायदेशीरपणा येईल, असे निर्देश न्यायालयाने सरकारला दिले.

UIDAI director general RS Sharma said the initiative would cover 51 districts in the country by 2013. Aadhaar-enabled applications will be used for making pension payments, wages under the Mahatma Gandhi NationalRural Employment Guarantee Scheme, Public Distribution System and scholarship payments, he said.
"The benefits range from better compliance management to reduced leakages and increased efficiency and accountability in service delivery," he said. Sharma said pilots of Aadhaar Enabled Service Delivery such as the public distribution system in East Godavari district of Andhra Pradesh, social security payment in Aurangabad in Maharashtra, LPG cylinder delivery in Mysore in Karnataka, MGNREGS payments in Ramgarh in Jharkhand and old-age pension payments in West Tripura district will be telecast live Saturday.
On the occasion, the 21st crore Aadhaar number will also be handed over, said Nilekani, adding that by 2014, around half of India"s population or 600 million citizens would have an Aadhar number. Aadhar was launched in 2010 to provide an irrefutable proof of identity to all citizens of India making it the world"s largest biometric-based identity database. UIDAI has spent around ` 2,000 crore so far on the project, said Sharma.
